Michigan, which in 2022 ensconced a \u201cright\u201d to abortion-on-demand into its state constitution, may be on the verge of another adaptation to the sexual revolution: adopting commercial surrogacy.<\/p>\n
The Great Lake State, along with Nebraska and to some degree Louisiana, are the three states that still outlaw commercial surrogacy. \u201cCommercial\u201d surrogacy is distinguished from \u201caltruistic\u201d surrogacy, where the latter is nominally a volunteer undertaking. I say \u201cnominally\u201d because (a) how does one really monitor financial exchanges in such quasi-private contexts and (b) when does \u201ccompensation for care\u201d (e.g., medical \u201cexpenses\u201d) blur into pay?<\/p>\n
Are you surprised that the vast majority of states allow trafficking in children? If you are, you\u2019re\u00a0soooo\u00a0<\/em>1987, when New Jersey\u2019s \u201cBaby M\u201d case was decided. As bioethics activist Jennifer Lahl has observed, America is the \u201cWild West\u201d when it comes to artificial reproduction.<\/p>\n Amid the controversies over abortion from the 1970s-90s, many state legislators decided to steer clear of any involvement in the emerging field of artificial reproduction, including surrogacy. And\u00a0Roe\u00a0<\/em>fostered a perspective of treating childbearing as an \u201cindividual liberty interest\u201d with which states should not interfere, a mindset that has perdured in the various post-Dobbs\u00a0<\/em>state constitutional amendments enshrining abortion-on-demand.<\/p>\n So, while those pushing commercial surrogacy in Michigan would like simply to suggest the state is catching up with all the others, in fact, the legislation advancing in Lansing is extreme.<\/p>\n Just as\u00a0Obergefell\u00a0<\/em>redefined marriage to eliminate sexual difference, Michigan\u2019s proposed surrogacy law redefines parenthood to eliminate genetics and the bodily. The only \u201cparent\u201d in law in Michigan would be the person(s) commissioning the baby.<\/p>\n If there are two, they wouldn\u2019t even need to live together or have any formal relationship to be listed as \u201cParent One\u201d and \u201cParent Two.\u201d (Yeah, sexual differentiation in parentage goes away, too). Parenthood becomes a state of mind.<\/p>\n We need to make ourselves fully aware of what that means.<\/p>\n For a child to come into existence requires genetics, gestation, and upbringing, what Catholicism once used to call\u00a0procreatio et educatio.\u00a0<\/em>You need a man for sperm; a woman to provide an ovum. You need a woman \u2013 who may or may not be the woman who provided the ovum \u2013 to bear that fertilized ovum for nine months.
