(CNSNews.com) – President-elect Joe Biden is promising that on \u201chis first day in office\u201d<\/a> he will issue an order requiring all schools that receive federal funding to let transgenders play on the sports teams and use the bathrooms and locker rooms that accord with their \u201cgender identity.\u201d<\/p>\n

Biden will take office next Wednesday, January 20.<\/p>\n

On his campaign website<\/a> Biden promised to: \u201cEnsure young LGBTQ+ people are supported and protected in our schools and college campuses by: Guaranteeing transgender students have access to facilities based on their gender identity.\u201d<\/p>\n

\u201cOn his first day in office,” says Biden\u2019s website<\/a>, \u201cBiden will reinstate the Obama-Biden <\/a>guidance revoked<\/a> by the Trump-Pence Administration, which will restore transgender students\u2019 access to sports, bathrooms, and locker rooms in accordance with their gender identity. He will direct his Department of Education to vigorously enforce and investigate violations of transgender students\u2019 civil rights.\u201d<\/p>\n

Biden\u2019s campaign website links to the \u201cObama-Biden guidance\u201d<\/a> this passage references. It was issued by the Obama Justice Department and Department of Education on May 13, 2016.<\/p>\n

It says in part<\/a>: \u201cTitle IX of the Education Amendments of 1972 (Title IX) and its implementing regulations prohibit sex discrimination in educational programs and activities operated by recipients of Federal financial assistance. This prohibition encompasses discrimination based on a student\u2019s gender identity, including discrimination based on a student\u2019s transgender status.\u201d<\/p>\n

\u201cGender identity refers to an individual\u2019s internal sense of gender,\u201d says this Obama-Biden orde<\/a>r. \u201cA person\u2019s gender identity may be different from or the same as the person\u2019s sex assigned at birth.\u201d<\/p>\n
