Heather Clark<\/a> – August 27, 2020<\/p>\n RICHMOND, Va. \u2014<\/strong>\u00a0A 2-1 panel with the Fourth Circuit Court of Appeals has again ruled that a Virginia school district discriminated against a female student who identifies as male by declining to allow her to use the boys\u2019 restroom.<\/span><\/p>\n \u201c[W]e hold that the board\u2019s restroom policy constitutes sex-based discrimination and, independently, that transgender persons constitute a quasi-suspect class,\u201d wrote<\/a> Judge Henry Floyd, appointed to the bench by then-President Barack Obama.<\/span><\/p>\n He stated that \u201c[n]o\u00a0one questions that students have a privacy interest in their body when they go to\u00a0the bathroom,\u201d but the school district \u201cignores the reality of how a transgender child uses the\u00a0bathroom: \u2018by entering a stall and closing the door.’\u201d Further,\u00a0those with gender identity issues do not present a \u201cpeeping tom\u201d threat as they will \u201cmind[] their business like any other student.\u201d<\/p>\n \u201cPut another way, the record demonstrates that bodily privacy of cisgender boys using the boys restrooms did not\u00a0increase when Grimm was banned from those restrooms,\u201d Floyd said. \u201cTherefore, the board\u2019s policy\u00a0was not substantially related to its purported goal.\u201d<\/span><\/p>\n He also opined in his ruling that \u201c[j]ust like being\u00a0cisgender, being transgender is natural and is not a choice.\u201d<\/p>\n Floyd asserted that transgenderism is \u201cnot a psychiatric condition,\u201d but simultaneously stated that those who struggle with their gender \u201care up to three\u00a0times more likely to report or be diagnosed with a mental health disorder as the general\u00a0population\u201d and noted that \u201c[g]ender dysphoria is defined in the American Psychiatric Association\u2019s Diagnostic &\u00a0Statistical Manual of Mental Disorders.\u201d<\/p>\n Floyd was joined in his opinion by Judge James Wynn, Jr., also an Obama nominee. Judge Paul Niemeyer, nominated by then-President George H.W.
