BOISE, Idaho \u2014<\/strong> A federal judge nominated to the bench by President Obama and renominated under President Trump has placed a halt on an Idaho law that expressly prohibits biological males from competing in women\u2019s sports.<\/span><\/p>\n

\u201cThe court recognizes that this decision is likely to be controversial,\u201d acknowleged Judge David Nye<\/a> on Monday. \u201cWhile the\u00a0citizens of Idaho are likely to either vehemently oppose, or fervently support, the Act, the\u00a0Constitution must always prevail.\u201d<\/span><\/p>\n

\u201c[T]he Act on its face discriminates between cisgender athletes, who may\u00a0compete on athletic teams consistent with their gender identity, and transgender women\u00a0athletes, who may not compete on athletic teams consistent with their gender identity,\u201d he said.<\/p>\n

\u201cHence, while the physiological differences the defendants suggest support the categorical\u00a0bar on transgender women\u2019s participation in women\u2019s sports may justify the Act, they do\u00a0not overcome the inescapable conclusion that the Act discriminates on the basis of\u00a0transgender status.\u201d<\/span><\/p>\n

As previously reported<\/a>, in February, Rep. Barbara Ehardt, R-Idaho Falls, proposed the \u201cFairness in Women\u2019s Sports Act\u201d, House Bill 500, which expressly prohibits biological males from joining women\u2019s athletic teams.<\/p>\n

\u201cAthletic teams or sports designated for females, women, or girls\u00a0shall not be open to students of the male sex,\u201d\u00a0the legislation<\/a>\u00a0reads in part.<\/p>\n

It states that puberty blockers and cross-sex hormones do not resolve concerns about fairness, pointing to a 2019 study that concluded that males who ingested the hormones over a 12-month period still\u00a0\u201chad an absolute advantage\u201d over their female competitors.<\/p>\n
