Texas Sues HHS, Says Biden Admin. Trying to ‘Transform Every Emergency Room in the Country into Walk-In Abortion Clinic’

The State of Texas, led by Texas Attorney General Ken Paxton, has sued the Department of Health and Human Services (HHS) over its attempt to “transform every emergency room in the country into a walk-in abortion clinic.”

The lawsuit, filed on July 14th, claims that “the Biden Administration’s response to Dobbs v. Jackson Women’s Health Org., 142 S. Ct. 2228 (2022), which ended the terrible regime of Roe v. Wade, is to attempt to use federal law to transform every emergency room in the country into a walk-in abortion clinic.”

The administration’s directive, released on July 11th, is a clarification of the Emergency Medical Treatment and Active Labor Act (EMTALA), a law that forces hospitals to treat patients regardless of their ability to pay and protects doctors from being prosecuted under state laws if they perform a procedure that they deem necessary to save a patient from death or serious injury in an emergency situation.

HHS Secretary Xavier Becerra’s letter says that “emergency medical conditions involving pregnant patients may include, but are not limited to, ectopic pregnancy, complications of pregnancy loss, or emergent hypertensive disorders, such as preeclampsia with severe features.”

Becerra’s letter goes on to state that an abortion may be an appropriate stabilizing treatment for pregnant patients with an emergency medical condition:

“When a state law prohibits abortion and does not include an exception for the life and health of the pregnant person – or draws the exception more narrowly than EMTALA’s emergency medical condition definition – that state law is preempted.”

Paxton’s lawsuit disagrees with this assertion: “To the contrary, EMTALA ‘do[es] not preempt any State or local law requirement, except to the extent that the requirement directly conflicts with a requirement of EMTALA.’”

EMTALA does not codify any right or access to abortion, so there is no direct conflict between EMTALA and a state law banning abortion, the suit alleges.

Doctors Say 5 Late-Term Aborted DC Babies Appear to Be Victims of Partial-Birth Abortion or Infanticide

A shocking discovery has Republican lawmakers calling for an investigation into a Washington, D.C. abortion clinic after pro-life activists gained possession of the remains of five fully-formed babies that reportedly came from the clinic.

The Progressive Anti-Abortion Uprising (PAAU) asked D.C. police to investigate if the babies were the victims of illegal abortions, but received no response. The D.C. medical examiner reportedly chose not to conduct autopsies, claiming the five late-term babies seem to have been legally aborted.

That led more than two dozen Republican members of Congress and other pro-life groups to take up the cause.

“We join in with their cry asking for the D.C. mayor and the medical examiner to give an autopsy to these children so we can know if this is a PB (partial-birth) abortion situation,” Live Action Correspondent Christina Bennett told CBN News’ Faith Nation.

Two physicians who examined photos of the remains disagree with the D.C. medical examiner. They say they believe it is indeed possible the babies were the victims of illegal partial-birth abortion, or even infanticide, according to a report published by LifeNews.com.

Dr. Robin Pierucci, a neo-natal specialist, said the babies “died at an age when they were viable, premature people.”

Dr. Kathi Aultman, a board-certified OB-GYN, and a former abortionist told LifeNews.com that unless a drug was given to kill one of the babies before the abortion, that one victim “may very well have been born alive and then left to die.” That would qualify as infanticide – the killing of a newborn baby.

Christians Banned from Holding Prayer Vigils, Peaceful Protests Near UK Abortion Clinic

The Manchester City Council has passed an order banning prayer vigils and peaceful protests around the Marie Stopes abortion clinic, the Christian Institute reports Friday.

The Public Spaces Protection Order (PSPO) has set up a buffer zone around the clinic in Fallowfield, within which people are forbidden to pray, distribute pro-life literature, or speak to anyone about abortion, measures pro-lifers have called “draconian” and an infringement on “freedom of speech.”

The one concession made by the council is a small designated space within the buffer zone where no more than three people may silently demonstrate with small placards.

Within the Restricted Area no person shall “protest, namely engage in any act of approval/disapproval or attempted act of approval/disapproval, with respect to issues related to abortion services by any means,” the PSPO reads. “This includes but is not limited to graphic, verbal or written means, prayer or counseling.”

People are also prohibited from displaying or distributing “any text or images relating directly or indirectly to the termination of pregnancy,” the order adds.

Within the small Designated Zone no person may “display any individual poster, text or image, singularly or collectively greater that one sheet of A3 paper,” it establishes.

The International Director at 40 Days for Life, Robert Colquhoun, said that up to now the pro-life vigils have always been “peaceful, prayerful, and legal.” His group will comply with the law, he said, but will continue praying outside the buffer zone.

Marie Stopes International, one of the world’s largest abortion providers, has been campaigning for buffer zones around all abortion clinics in Great Britain, insisting that “the UK is a pro-choice nation.”

“We are a firmly pro-choice nation, but sadly, a small minority of people believe otherwise and would like to see the country take a backwards step on abortion,” Marie Stopes UK Managing Director Richard Bentley wrote last year.

“These anti-abortion groups who gather outside clinics have a detrimental impact on women, our team members and residents, and whether their behavior is subtle or overt, it is a form of discrimination against women and targeted street harassment,” he said.
